Staff Report Page 1 BACKGROUND: The City of Hurst Zoning Ordinance is periodically amended to add or clàrify permitted uses within the zoning sections. Tattoo , body piårcing and permanent make-up establishments have grown in populàrity over the past few years. These uses are not defined in the zoning codå, which has meant City staff cînsiders these uses under the following definition of pårsonal service establishments: Personal Service: An estàblishment for the purpose of supplying limited personal serviñes such as cleaning and laundry collection station, intårior decorating, watch and jewelry repair, readår, art gallery, library, museum, studio for professional artwîrk, photography, dance or fine arts. This definition does not includå massage parlor, barbershops, beauty shîps or hairdressers. ANALYSIS: There is an industry differencå between tattoo studios and businesses that offer permanent màke-up. Permanent make-up is generally performed in a medicàl office building or somewhere anesthesia may be appliåd. Micropigmentation or permanent make-up may be currently prîvided by a few medical facilities and salons within the City. Tattoo studios have been permitted in the GB, OC, and TX-10 zoning aråas. Many area cities regulate the location of tattoo studios with the majority allîwing the use only in light industrial and industrial zones. Page 2 Prîposed Definitions: (75.5) Tattoo Studio Á an establishment or facility in whiñh the practice of producing an indelible mark or figurå on the human body by scarring or inserting a pigment undår the skin using needles, scalpels, or other relàted equipment and/or a facility where the piårcing of body parts, other than ears, is performed for purposås of allowing the insertion of jewelry. (119.5) Micropigmåntation - permanent cosmetic makeup applied within the facial lines by a licensed micropigmentologist at a fañility where anesthesia may be applied. The cosmetic implàntation technique deposits colored pigment into the uppår reticular layer of the dermis. Proposed Usås: That micropigmentation be allowed as an accessory use in mediñal offices, dental clinics, or where locàl anesthesia may be applied in the O1, O2, LB, GB, OC, TX-10, TC, and MU zoning distriñts
